1. Who we are
This Privacy Policy explains how Bismarck Ndou ("we", "us") collects, uses, and protects personal information when you buy from or use products from the Bismarck Ndou store on Whop, contact us, or work with us on a project. We are the data controller for the information described here. Contact: [email address shown when the page loads].
2. Information we collect
Account and purchase details: your name, Whop username, email address, and what you bought, which Whop shares with us when you purchase.
Information you give us at checkout or later: project descriptions, timezone and availability, messages, files, business information, and anything you share during calls.
Project access: credentials, API keys, or access to systems that you provide so we can deliver your project.
Usage data from our hosted software: for products such as Web Scraper and MCP Server, technical data such as job configurations, request logs, timestamps, IP address, and error reports.
Payment information: payments are processed by Whop and its payment partners. We do not receive or store your full card or bank details; we only see limited information such as the amount, date, and payment status.
3. How we use your information
To deliver what you purchased: scheduling calls, scoping, building, delivering, and supporting your project or software. To communicate with you about your order, project, and support requests. To run, secure, debug, and improve our hosted software. To handle refunds, disputes, and chargebacks. To meet legal, tax, and accounting obligations.
We use your email for marketing only if you have opted in, and you can opt out at any time. We do not sell your personal information.
4. Legal bases
Where data-protection law requires a legal basis, we rely on: performance of a contract (delivering what you bought); our legitimate interests (securing and improving our services, preventing fraud, and defending legal claims), balanced against your rights; legal obligation (tax and accounting records); and consent (optional marketing), which you can withdraw at any time.
5. Who we share information with
We share personal information only as needed to provide our services: Whop, which operates the store, checkout, chat, and payments under its own privacy policy; service providers we use to deliver work, such as hosting and cloud providers, code repositories, video-call tools, email, and AI model providers used to build or run AI features; professional advisers such as accountants or lawyers; and authorities where the law requires it, or to protect our rights in a dispute.
Our providers may only use your information to perform services for us. We will not share your project materials or credentials with anyone beyond what is necessary to deliver your project.
6. International transfers
We are based in Zimbabwe, and Whop and many of our service providers operate in other countries, including the United States. Your information may therefore be processed outside your country. Where required, we rely on appropriate safeguards offered by those providers, such as standard contractual clauses.
7. How long we keep information
Purchase and invoicing records: for as long as tax and accounting law requires (generally up to 7 years). Project files and communications: for the life of the project plus up to 2 years, so we can provide support and handle any claims. Credentials and access you provided: deleted or revoked at project completion, or sooner on request; we recommend changing passwords and rotating API keys after handover. Hosted software logs: generally up to 90 days unless needed to investigate a problem.
8. Security
We use reasonable technical and organisational measures to protect your information, including encrypted connections, access controls, and limiting access to people who need it. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach affects your personal information, we will notify you where the law requires.
9. Your rights
Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to withdraw consent. To make a request, email [email address shown when the page loads]. We will respond within 30 days and may need to verify your identity. You also have the right to complain to your local data-protection authority; in Zimbabwe, this is the Postal and Telecommunications Regulatory Authority of Zimbabwe (POTRAZ), the data protection authority under the Cyber and Data Protection Act.
10. Data in projects we build for you
If we build software that processes your own customers' personal data, you are the controller of that data and we act on your instructions as a processor. We will process it only to build, test, and support your project, keep it confidential, and delete or return it at the end of the project on request.
11. Children
Our products and services are intended for people aged 18 and over. We do not knowingly collect personal information from children. If you believe a child has given us personal information, contact us and we will delete it.
12. Changes to this policy
We may update this Privacy Policy from time to time. The latest version will always be available on our Whop store, with the effective date at the top.
